TERMS & CONDITIONS – CHICHESTER MUSICAL PROJECTS LTD

1 INFORMATION ABOUT US

1.1 All projects are operated by Chichester Musical Projects Ltd (“we”, “us” and “our”).  We are registered in England and Wales under company number 10726252 and have our registered office at 52 Oakfield Avenue, East Wittering, PO20 8BT. This is also our main trading address and address for correspondence. We are a limited company.

2 HOLIDAY CLUB TERMS & CONDITIONS

2.1 These Terms & Conditions (“Terms”) set out all the terms and conditions upon which we provide your children with access to a holiday club organised by Chichester Musical Projects Ltd (“Holiday Club”).

2.2 Please read these Terms carefully before booking the holiday club. By booking onto a holiday club for your child, you agree to be bound by these Terms.

2.3 Bookings of holiday clubs  (“Bookings”) are fully refundable under the following conditions; 

2.3.1 We reserve any rights to cancel the holiday club due to lack of numbers;

2.3.2 You can cancel at any time for illness of a child. (A letter from your Doctor is required for a refund)

2.3.3 Death or serious injury to child or close family member. 

2.3.4 Any other cancellations you will not receive any refund.

2.4 The price for a Booking includes:

2.4.1 admission to all activities specifically organised for the holiday club;

2.4.2 use of the school being used for activities (supervised at all times throughout the day);

2.4.3 limited snacks and refreshments provided at certain times in the day;

2.4.4 one t-shirt for each holiday club, size may differ to the size specified at booking depending of availability.

2.4.5 free tickets for parents and guardians to attend the final performance of the musical.

2.5 Upon booking, you agree that your child will:

2.5.1 respect the property of others;

2.5.2 respect and treat others as they wish to be treated;

2.5.3 not use abusive or obscene language; and

2.5.4 not be aggressive.

2.5 The well-being and safety of children in our care is our main concern.

2.6 Chichester Musical Projects Ltd reserve the right to deny admission, or to require you to remove a child from the holiday club, without refund or compensation, for failure to comply with any of the holiday club rules, for unsafe, illegal or offensive behaviour, to ensure safety, security or order, or if we consider that the circumstances so require.  

2.7 We will hold you responsible financially for any damage to property belonging to us or to the school caused by any child for whom you are responsible.

2.8 You accept these Terms on behalf of every child for whom you have booked a holiday club and shall ensure that these Terms are notified to and followed by such children.

3 STANDARD HOURS

3.1 Our standard hours for all holiday clubs are 8:30am to 3.30pm.

3.2 On the final day (Friday) there will be a performance of the musical the children have put together at 3.30pm until 4.30pm. Therefore pick-up time will be at 4.30pm from the playground.

3.2.1 If any person is wishing to attend the performance you must arrive and be seated by 3.20pm.

3.3 Drop-off of children will be at the reception desk of Portfield Primary School, St James road, Chichester between 8:00am and 8.30 am.

3.4 Late drop-off: if you arrive after 9am, you must contact one of the leaders whose numbers should be available to you in the welcome pack.

3.5 Pick-up of children will be in the playground at 3.30pm

3.6 Late pick-up: 

3.6.1 All children MUST be picked up by 4.00pm. If for any reason, you are unable to collect your child by 4.00pm, please call one of the designated leaders as soon as possible. Two members of staff will wait with your child until they are collected.

3.6.2 You will be charged a late pick-up fee of £25 for every 15 minutes after 4.00pm to cover the additional staffing cost. 

3.6.3 If we have no contact from a parent/guardian by 4.00pm we will contact Social Services to advise them that we have an uncollected child.

3.7 Early pick-up: if you need to pick your child up earlier than 3.30pm, you must inform us at the beginning of the holiday day and come to reception at the agreed time to collect your child. 

4 HOLIDAY CLUB ENTRY RULES

4.1 Entry to our holiday club is subject to your child:

4.1.1 being between 7 and 11 years old (inclusive) at the time of the holiday club. Chichester Musical Projects operates a strict age policy and we may ask for their passport as a form of identification if we need to verify their age. For the avoidance of doubt, age means a person’s legal age (ie according to actual date of birth);

4.1.2 being toilet-trained; and

4.1.3 not being infectious.

4.2 If your child has any medical condition, disability or other additional needs that may impact upon your child’s participation in the holiday club please notify by emailing info@chichestermusicalprojects.co.uk in advance of your booking so we can cater for your child’s needs and put in place any appropriate arrangements to ensure your child has the best experience with us. Where a child has any allergies or additional needs we will share this information only with the other leaders to keep that child safe. If you do not want this information shared please notify us in advance. Where a child requires a one-to-one support, we will permit a parent or carer to attend the club to support the child.

4.3 With the exception of a packed lunch, children may not bring outside food and beverages in to the holiday club.

4.4 Chichester Musical Projects Ltd accepts no liability for the loss or damage to property (including cash) brought into the holiday club by children. We advise that children do not bring valuables to the holiday club.

4.5 Children may only be collected from the holiday club by either:

4.5.1 the adult who has accompanied the child/ren at check-in; or

4.5.2 a nominated adult who has been named at check-in and the identity if confirmed by the child/ren.

4.6 We will not be able to release any children without either the accompanying or nominated person being present. 

5 HOW TO BOOK A SUMMER CAMP

5.1 Bookings can be made by purchasing a product from our online store and by filling in the checkout form website. Each payment related to 1 place for 1 child however there is only one checkout form for multiple bookings.

5.2 All Bookings must be paid for in full at the time they are made either by credit card, debit card or paypal. 

5.3 You will be asked to provide the following details at the time of booking:

5.3.1 Name and age of child;

5.3.2 Name of parent/guardian;

5.3.3 Contact number and email address of parent/guardian;

5.3.4 Address of parent/guardian; and

5.3.5 Allergies/sensitivities/disabilities of the child.

5.3.6 T-shirt size of the child

5.4 All Bookings will be confirmed by email. It is your responsibility to check the accuracy of the details on your email confirmation as mistakes cannot always be rectified.

5.5 The price may vary from time to time. Prices are in UK Sterling and include VAT.  

5.6 Prices:

5.6.1. Each individual holiday club show week is £125 per child

5.6.2 We offer a bulk package price of both show weeks for £210

5.6.3 We offer a sibling discount of 10% if you book for more than 1 child who shares a parent or guardian. You can redeem this by using the code siblings10 at the checkout. 

5.6.4 We offer an optional packed lunch and veggie packed lunch at the cost of £20 for the week which can be purchased from the online store. 

5.7 Subject to clause 9.1, cancelled Bookings are only refundable under the circumstances outlined in clause 2.3. Any other cancelled bookings are non-refundable.

5.8 If a child cannot attend the Summer Camp you have booked for them, you must call 07851473435 or email info@chichestermusicalprojects.co.uk to allow us to update our records.

6 FOOD

6.1 Snacks will be provided to children free of charge. These will be nut-free.

6.2 Lunch is not provided. You can purchase an optional provided lunch which will at least include a sandwich/roll, snack, fruit and a drink. If you have not opted for this lunch, you will be required to bring a nut-free packed lunch for your child. 

6.3 You must advise us of any food allergies in advance. We will not hold responsibility for any illnesses caused by an allergy if we have not been informed of in advance.

7 ACTIVITIES

7.1 All activities within the holiday club are purely recreational/educational. 

7.2 Some activities may be outside so prepare your child with suncream and a hat if the weather requires. 

8 FIRST AID AND INJURY

8.1 In the event of an accident, first aid will be administered to children, and the emergency services will be called if necessary;

8.2 Children must keep their essential prescribed medication with them at all times.

8.3 There will be at least 1 member of staff trained in paediatric first aid, Epi-pen usage and asthma.

8.4 We will not accept responsibility for any injury to vocal chords caused by over-exertion. Children voices will be correctly prepared for the activities. 

9 SUMMER CAMP CANCELLATION

9.1 In rare circumstances beyond our control, we reserve the right to cancel a Summer Camp but we will endeavour to notify you as soon as we become aware that this is necessary. Should we have to cancel your Booking we will refund you all the monies you have paid to us within fourteen (14) days of cancellation. 

10 PERFORMANCE

10.1 There will be a performance of each musical on the last day, Friday at 3.30pm. 

10.2 Any performance will include costumes, set, props, lighting and live music.

10.3 Costumes:

10.3.1 The children will be aware of their role on the first day.

10.3.2 You must provide your child/children with any relevant costume. This doesn’t have to be bought especially, we will endeavour to keep it simple so children are able to wear their own clothes. 

10.3.3 Costumes must be provided and brought in on Thursday for checks and any dress rehearsals. Each item must be clearly labelled with the name of the child to whom they belong. 

10.3.4 We will provide anything specific to a character eg. bow and arrow, crown.

10.3.5 There may be face paints involved. If your child has sensitive skin or is intolerant to face paint you must let us know in advance. 

10.4 The children may be involved in helping create some of the set during the week. This may involve glue and paint. We will endeavour to protect clothes from these things but please dress your child in appropriate clothes for this activity in case of unavoidable stains. 

10.5 Any necessary props for the show will be provided by us. Your child is permitted to bring in any props but these must be clearly labelled with the name of the child to whom they belong. We will not accept any liability for the loss of property brought in by the child. 

10.6 The shows will be accompanied by piano and drums.

11 FILMING AND PHOTOGRAPHY

11.1 From time to time, we may carry out photography and/or video recording at the holiday club which may feature the children. By accepting these Terms, you, being the parent or legal guardian of such persons, or person duly authorised by the parent or legal guardian of such person, consent to the use of such images and/or recordings by us in connection with advertising, promoting the holiday club or any future projects run by Chichester Musical Projects (such as on the Chichester Musical Projects website, social media sites and pages, partner sites, advertising and brochures for any future projects), and for our internal purposes, and in doing so, you allow us to edit, modify, publish and make available such images and/or recordings.  You acknowledge and agree that you will not receive compensation if we use such images and/or recordings for the purposes set out above. You further agree that copyright in these materials rests with Chichester Musical Projects or such authorised party (as the case may be).

11.2 Please note that some activities may include your child’s image or voice featuring in photographs or recordings with other children.

12 EVENTS OUTSIDE OUR CONTROL

12.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control. 

12.2 An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.

12.3 If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms: 

12.3.1 we will contact you as soon as reasonably possible to notify you; and

12.3.2 our obligations under these Terms will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

13 YOUR INFORMATION

13.1 We only use your personal information in accordance with our Privacy Policy.  For details, please see our website. Please take the time to read these, as they include important terms which apply to you.

14 INTELLECTUAL PROPERTY RIGHTS

14.1 We are the owner or the licensee of all intellectual property rights in our website, in the material published on it, the concept of the holiday club, all rights to all materials within Chichester Musical Projects including, without limitation, any text, graphics, images, artwork, illustrations, photographs, animations, music, video, audio, audio-visual works, designs, logos, software and any other content unless owned by a third party. 

15 OUR LIABILITY TO YOU

15.1 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of the Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into this contract. 

15.2 Our liability for losses you suffer as a result of us breaching a contract between us is strictly limited to the purchase price of the holiday you booked.  

15.3 We do not exclude or limit in any way our liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and fraud or fraudulent misrepresentation.  

15.4 We are not responsible for indirect losses which occur as a side effect of the main loss or damage, or for any losses that fall into the following categories: loss of income or revenue, loss of business loss of profits or contracts, loss of data or waste of management or office time, loss of goodwill, disappointments or emotional distress and/or any other loss or damage which was not reasonably foreseeable by us at the date the holiday club was booked, however arising and whether caused by tort (including negligence), breach of contract otherwise, even if foreseeable. 

16 OTHER IMPORTANT TERMS

16.1 We have the right to revise and amend these Terms from time to time by notifying you or placing updated Terms on our website.  You may not vary these Terms unless agreed in writing with us.  You will be subject to the Terms in force at the time that you booked a holiday camp with Chichester Musical Projects (unless otherwise notified in writing).  

16.2 We may transfer our rights and obligations under these Terms to another organisation, and we will always notify you in writing if this happens, but this will not affect your rights or our obligations under these Terms.

16.3 You may not transfer your rights or your obligations under these Terms to another person.  

16.4 This contract is between you and us. No other person shall have any rights to enforce any of its terms. 

16.5 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

16.6 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you. 

16.7 If any of these Terms is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law. 

16.8 These Terms and any document referred to in them constitutes the whole agreement between us and supersedes all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these Terms.

16.9 You acknowledge that, in agreeing to these Terms, you do not rely on any representation or warranty (whether made innocently or negligently) that is not set out in these Terms.  Nothing in this paragraph excludes liability for fraud.  

16.10 These Terms are governed by English law. You and we both agree to submit to the non-exclusive jurisdiction of the English courts. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
